By using smartskn.com, creating an account, placing an order, or participating in the SmartSKN Provider program, you agree to these terms.
1. Who we are
SmartSKN provides AI-powered skin analysis technology (the Muilli AI Dermascope and companion app) and personalized cosmeceutical skincare, compounded to order through our robotic lab and shipped directly to customers.
2. Cosmetic, not medical
SmartSKN skin analysis and products are cosmetic. Nothing on our platform is a medical examination, diagnosis, prescription, or treatment, and nothing replaces the advice of a physician or dermatologist. Providers using SmartSKN act within their own professional scope of practice.
3. Accounts
You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account. You must be 18 or older to create an account or place an order.
4. Orders, subscriptions, and payment
- Personalized products are made to order based on a skin scan and cannot be produced without one.
- Prices are shown at checkout. Payment is processed by Stripe.
- Subscriptions renew automatically at the frequency you select and bill to your payment method on file. You can cancel future renewals from your account or by contacting us; cancellation takes effect for the next unbilled renewal.

5. SmartSKN Providers — additional terms
Eligibility. The program is open to qualified skincare professionals, aesthetic practices, and approved skincare business owners. Eligibility is verified during provider setup, and you must hold and maintain any license your services require. Purchase of a Muilli AI Dermascope is required to activate a provider account.
Client consent — required. Before scanning any client, you must clearly inform them and obtain their consent to the collection of their skin images and measurements through the SmartSKN platform, including any consent form the app presents. Where the client's state requires specific consent for biometric or health-related data, you are responsible for obtaining it. Never scan a client who has not consented, and never scan anyone under 18.
Client data — handle with care. You may access client scans, results, and orders only to serve that client. You may not download, copy, share, sell, or use client data for any other purpose, and you must protect the confidentiality of anything you access through the platform. When a client asks you about their data rights, refer them to SmartSKN's Privacy Policy.
Professional conduct. You will present SmartSKN analysis as cosmetic information — not as medical diagnosis — and will not make medical claims about SmartSKN products. You are an independent business, not an employee, agent, or franchisee of SmartSKN, and you are responsible for your own taxes, licenses, and legal compliance.
Commissions. Commission rates, tiers, attribution windows, and payment schedules are described in the provider program materials and your provider dashboard, and may be updated with notice. Commissions are paid via Stripe Connect and require a valid connected account. SmartSKN may withhold or reverse commissions on refunded, fraudulent, or policy-violating orders.
Device. The Muilli AI Dermascope includes a 12-month warranty against defects. It is professional equipment for use as directed; the warranty does not cover damage from misuse.
Termination. Either party may end program participation at any time. SmartSKN may suspend or terminate provider access for violation of these terms, misuse of client data, or unlawful conduct. Earned, eligible commissions accrued before termination will be paid per the normal schedule.
6. Intellectual property
The SmartSKN name, Muilli, our skin-code system, software, content, and designs belong to SmartSKN and its licensors. You may not copy, modify, or reverse-engineer them. Providers may use SmartSKN marketing materials we provide, as provided.
7. Acceptable use
You may not misuse the platform: no unlawful activity, no interfering with the service, no accessing data that is not yours, no scraping or reselling of platform content.
8. Disclaimers and limitation of liability
The service is provided "as is." To the fullest extent permitted by law, SmartSKN disclaims implied warranties and is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, and nothing limits your rights under your state's consumer protection laws.
9. Dispute resolution and arbitration
Please read this section carefully — it affects your legal rights.
Individual arbitration. Except as provided below, any dispute between you and SmartSKN arising from these terms or the Services will be resolved by binding individual arbitration before a single arbitrator, rather than in court. The arbitration will be administered by a recognized arbitration provider under its consumer rules, may proceed by remote participation where appropriate, and SmartSKN will pay arbitration costs where consumer law requires it.
Class-action and jury waiver. You and SmartSKN each waive the right to a jury trial and the right to participate in a class, collective, or representative action. Claims may be brought only on an individual basis.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek emergency injunctive relief or pursue intellectual-property claims in court.
Your right to opt out. You may opt out of this arbitration provision by emailing info@smartskn.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these terms. Opting out does not affect any other part of these terms.
Governing law. These terms are governed by the laws of the Commonwealth of Massachusetts. Any matter not subject to arbitration will be resolved in the state or federal courts located in Massachusetts.
